Artwork, Trademark, and Design Approval Disclaimer

By submitting artwork, logos, or branding materials and formally approving this design proof, the Customer explicitly agrees to the following terms and conditions regarding manufacturing, printing, and legal liability:

Authorization and Right to Use: The Customer warrants, represents, and guarantees that they are the sole owner of, or possess the lawful license, express permission, and legal right to utilize, reproduce, and publicly display all trademarks, service marks, logos, copyrights, slogans, and graphic designs submitted for print reproduction.
Indemnification and Hold Harmless: The Customer agrees to indemnify, defend, and hold completely harmless The Smart Tarp Company (BrandAll, LLC), its officers, directors, employees, and subcontractors from and against any and all claims, demands, liabilities, damages, costs, or expenses (including, but not limited to, reasonable attorney’s fees and legal costs) arising out of or related to any alleged or actual infringement of third-party intellectual property rights, copyrights, patents, or registered trademarks.
Assumption of Responsibility upon Approval: The Customer’s formal approval of the digital design proof constitutes an absolute, binding acknowledgement that the visual layout, spelling, logo positioning, and graphics are correct and authorized for production. The Smart Tarp Company assumes no liability for errors, trademark disputes, or unauthorized brand use once final proof approval is executed by the Customer. The Customer assumes full, sole responsibility for the final printed asset's field deployment and neighborhood public display.
Custom Order Abandonment & Design Approval Policy

Due to the highly customized, print-on-demand nature of our engineered commercial equipment, production cannot begin until the customer provides written approval of their brand mock-ups. The Smart Tarp Company (BrandAll, LLC) commits to delivering initial digital mock-ups within a standard business window following order placement.

It is the sole responsibility of the customer to monitor their provided communication channels (including spam filters) and provide timely approvals or revision requests.

The 60-Day Unresponsive Threshold: If a customer fails to provide a written response, design approval, or revision request within thirty (60) calendar days of the initial mock-up delivery, the project will officially be flagged as "Abandoned."
Conversion to In-Store Credit: Upon reaching the 60-day abandonment threshold, the order will be deactivated. Any funds paid toward the order will automatically be forfeited as a cash refund and converted 100% into a non-expiring In-Store Credit. This credit may be applied to any future product purchase or manufacturing run with The Smart Tarp Company.
